The ninth circuit has talked – and apparently, creating a safe platform that gives rise to innovation is now the basis of punishment. By maintaining a district court treatment, the court has given Apple complete dominance of the app market over a silver player.

This misleading treatment will not promote or help consumers, but will endanger the confidence and value of developers in the Android ecosystem.
